MENJELAJAHI KESETARAAN FINANSIAL: PERSPEKTIF NAFKAH DALAM CODE OF PERSONAL STATUS TUNISIA
Abstract
This study examines the changes in family law and spousal maintenance aspects in Tunisia, which have sparked controversy through several key breakthroughs related to financial equality. This distinction is evident in many legal systems based on traditional Islamic law, which typically places primary financial responsibility on the husband. The research aims to investigate aspects of spousal maintenance under the Code of Personal Status in Tunisia, highlighting amendments that expand the role of women in the family, and exploring debates surrounding the Code of Personal Status. The research methodology employed is a literature review with a juridical-formal approach, utilizing data from the Code of Personal Status in Tunisia, Islamic legal literature, and relevant articles. The study findings indicate that the Code of Personal Status has undergone a series of amendments to broaden the rights and financial responsibilities of women in the family, based on the Maliki School of thought. The imposition of criminal sanctions in Tunisia's family law reflects the state's efforts to ensure protection and justice, especially for women, in the context of marriage
