ANALYSIS STUDY ON THE MEANING OF SIRRI MARRIAGE IN HADITH PERSPECTIVE

Abstract

Sirri marriage is a classic term that has attracted the attention of Islamic law thinkers from the classical to modern times regarding the development and expansion of meaning that occurs in various regions of the world that use Islamic law as a basis in the formation of legislation, especially the Indonesian state considering the motives of religious prohibitions for carry out a sirri marriage with consideration of the negative impacts caused by the marriage. With the expansion of the meaning in this term gave birth to a new understanding of marriage law, especially in the field of marriage administration.
Some scholars are of the opinion that sirri marriage is a hidden marriage, so the marriage must be announced. However, for those who think that unregistered marriages are imperfect witnesses, then they must present witnesses perfectly, both two men or a man and two women, and even though it is not broadcast, the marriage is not called sirri marriage, and the last concept is sirri marriage in meaning a marriage that is not registered with a marriage registration institution, it is required to register the marriage.
